Kejaksaan Agung (Kejagung) mengembalikan berkas perkara kasus dugaan pemalsuan sertifikat pagar laut Tangerang dengan tersangka Kades Kohod, Arsin dan kawan-kawan ke Bareskrim Polri. Pengembalian ini disertai petunjuk untuk menindaklanjuti ke ranah tindak pidana korupsi.
“Pengembalian berkas ini dilakukan sesuai dengan ketentuan Pasal 110 ayat (2), (3) dan Pasal 138 ayat (2) KUHAP guna dilengkapi dalam jangkawaktu 14 hari,” kata Kapuspenkum Kejagung, Harli Siregar dalam keterangannya, Rabu (26/3/2025).
Harli menjelaskan, berkas perkara yang dikembalikan ini berkaitan dengan dugaan tindak pidana pemalsuan dokumen dan/atau penggunaannya dalam proses penerbitan sertifikat hak milik(SHM) di atas wilayah perairan laut di Desa Kohod, Kabupaten Tangerang.
Dugaan ini mencuat karena sertifikat tersebut diduga digunakan untuk memperoleh keuntungan secara tidak sah dalam proyek pengembangan kawasan Pantai Indah Kapuk (PIK) 2 Tropical Coastland,” ujarnya.
Menurutnya, Analisis Jaksa Penuntut Umum mengungkap adanya indikasi kuat bahwa penerbitan SHM, SHGB, serta izin PKK-PR darat dilakukan secara melawan hukum.
Dugaan tersebut, lanjut dia meliputi pemalsuan dokumen, penyalahgunaan wewenang oleh pejabat publik, serta adanya indikasi penerimaan gratifikasi atau suap oleh para tersangka, termasuk Kepala Desa dan Sekretaris Desa Kohod.
